Welcome to Michelle Farmer Art. This Site is owned and operated by Michelle Farmer (referred to in these terms as "me", “we”, “us”, and “our”), and based in Perth, Western Australia.
By accessing or using this website, you agree to comply with and be bound by these terms and conditions. Please take the time to read the terms of use that are applicable to your use and enjoyment of this Site and the content made available to you via this Site and our social media channels, as well as your purchase of any products from our online store (“Terms”). These Terms, together with our Privacy Policy, apply to all Site visitors, subscribers, customers, and other users of our Site (“user”, “you” and “your”).
2. Intellectual Property
All content on this website, including but not limited to artworks, text, images, logos, and graphics, is the intellectual property of Michelle Farmer Art unless otherwise stated. Unauthorized reproduction, distribution, or use of any content is strictly prohibited. Permission must be obtained in writing for any use.
You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever our Site or its Content in whole or in part without our prior written consent. We reserve the right to immediately revoke your access to our Site and its Content, without refund, if you are found to be violating these Terms.
3. Purchase Terms
Product Descriptions: Every effort is made to provide accurate descriptions and images of artworks. However, minor variations may occur due to differences in monitors or printing processes. If you have questions about specific pieces, please reach out before making a purchase.
Prices and Payment:
- All prices are listed in Australian Dollars (AUD).
- Payment is accepted via bank deposit. Payment details will be provided upon ordering.
- Orders must be paid in full before items are dispatched. Once your payment is received, you will receive confirmation of payment via email.
Custom Orders: Custom and commissioned artworks require a non-refundable deposit of 50%. The remaining balance must be paid before the artwork is shipped or delivered. Full terms will be outlined in a written agreement for all custom orders.
- We reserve the right to modify or discontinue any product without notice at any time. We shall not be liable to you or any third party for any modification, price change, suspension or discontinuance of any product.
- We reserve the right to cancel an order and provide a full refund in the event that a product has been discontinued, or we do not have the stock available.
- We reserve the right to cancel any order where we suspect that there is fraud or other types of illegal or unauthorised activity.
4. Shipping Policy
Processing Times:
- Orders are processed within 5 business days, except for print orders.
- Print orders are produced on demand and may take up to 3 weeks for professional printing to be finalised before shipping. Please allow for this additional time when estimating the total receipt time.
Domestic Shipping: Orders within Australia are shipped using Australia Post or another reliable courier service. Tracking details are provided once the order is dispatched, with estimated delivery times of 5–10 business days (in addition to preparation time for print orders).
International Shipping: International orders are shipped worldwide. Delivery times vary based on the destination. Buyers are responsible for any customs fees, duties, or taxes incurred.
Packaging: Artworks are carefully packaged to ensure they arrive undamaged. Prints are typically shipped in rigid mailers or tubes, and original artworks are securely wrapped and boxed for extra protection.
Shipping Delays: Michelle Farmer Art is not liable for delays caused by courier services, weather, or customs clearance.
Insurance: Insurance is highly recommended, particularly for framed orders, to protect against loss or damage during transit. Contact me to discuss adding insurance to your shipment.
5. Return and Refund Policy
Original Artworks: Due to the unique and handmade nature, original artworks are non-refundable and unable to be replaced if damaged. Please consider insurance with your shipping to prevent any issues arising.
Custom Orders: Custom and commissioned works are non-refundable, as they are tailored to individual requirements.
Commissioned Artworks: Commissions aren't eligible for refunds, as they are tailored specifically to your preferences and are often one-of-a-kind, original artworks. We strive to ensure your satisfaction during the commissioning process.
Damaged or Defective Items: If your item arrives damaged or defective, please contact us immediately with photos of the damaged item(s). We will review and discuss options for a replacement or refund in accordance with Consumer Law in Australia. If there is an error with your order on our part (e.g., wrong item shipped), we will cover the return shipping costs to have the items sent back to us.
Refund Process: Approved refunds will be processed within 10 business days to the original payment method.
6. Privacy Policy
Information Collection: Personal details, such as your name, email address, and shipping information, are collected when you place an order or contact me.
Usage of Information: Your information is used solely for processing orders, responding to inquiries, and sending occasional updates about Michelle Farmer Art (if you opt into my mailing list).
Data Security: Personal information is stored securely and is never shared or sold to third parties.
Cookies: This website may use cookies to improve your browsing experience. Cookies are small files stored on your device that track non-personal information. They can be disabled in your browser settings.
7. Limitation of Liability
Michelle Farmer Art is not responsible for:

- Loss or damage to artworks during transit unless deemed eligible under the refund/replacement policy.
- Errors in pricing or product descriptions, although efforts will be made to promptly correct any mistakes.
